Terms of Use
Fruit Tree Coach is published by Moonstone Media Group ("we", "us"). These terms cover the Fruit Tree Coach mobile app ("the app") and our website (fruittreecoach.com). By creating an account or using the app you agree to them. If you do not agree, please do not use the app.
Our Privacy Policy explains what we collect and why. It is part of these terms.
What the app is
The app gives weekly care suggestions for backyard fruit trees, timed to the USDA hardiness zone of the ZIP code you enter. We grant you a personal, non-transferable license to use it on devices you own, for your own trees, for as long as you have an account in good standing. The app, its guides, and its design belong to us or our licensors; you may not copy, resell, or redistribute them.
Your account
You need an account to use the app. Keep your password to yourself, and tell us if you think someone else has used your account. You must be at least 13 years old. You are responsible for what you enter: tree names, notes, and anything you send us.
Subscription and free trial
Fruit Tree Coach is a paid subscription, billed through your Apple account. Two plans are offered, monthly and yearly, and the price of each is shown in the app before you subscribe. Both renew automatically at the end of each period until you cancel.
New subscribers get a free trial, and the app shows how long it lasts before you start. Your Apple account is charged when the trial ends unless you cancel at least 24 hours before then. A free trial is offered once per Apple account.
You can cancel at any time in your device Settings, under your Apple Account, then Subscriptions. Cancelling stops the next renewal; you keep access until the end of the period you have already paid for. Apple handles all payments and refunds. To request a refund, use Apple's Report a Problem page; we cannot issue refunds ourselves.
If we change a price, the change applies to renewals after we have told you, and you can cancel before it takes effect.
Care guidance is general guidance
The app's recommendations are general horticultural guidance based on your USDA zone and published university extension sources. They are not a guarantee of any result. Every tree, yard, and season is different, and we cannot see yours.
- Use your judgment. A task that fits the calendar may not fit your tree this year. If a suggestion looks wrong for your situation, skip it.
- Pruning and tools carry risk. Follow the safety instructions for any tool, and get help for work at height or near power lines.
- Follow the label. For any fertilizer, spray, or other product, the label and your local regulations govern how, when, and whether to use it, not the app.
- Ask a professional for a tree that is diseased, unsafe, or valuable.
To the fullest extent the law allows, we are not liable for damage to trees, plants, property, or people, or for lost harvests, arising from how you use the guidance.
Available in the United States
The app is designed for US locations and requires a US ZIP code. Using it elsewhere may produce guidance that does not fit your climate, and we do not support that use.
Links to Amazon
Some guides recommend tools and supplies with links to Amazon. As an Amazon Associate we earn from qualifying purchases, at no extra cost to you. The app says so next to the links. We do not sell those products, and Amazon's own terms apply once you leave the app.
Deleting your account
You can delete your account at any time from Profile, under Account. Deletion is immediate and permanent. Deleting your account does not cancel your Apple subscription, because Apple holds it, not us: cancel it first in your device Settings.
Acceptable use
Do not try to break into the app or our systems, interfere with other users, use the app for anything unlawful, or work around the subscription. We may suspend or close an account that does.
Warranties and liability
The app is provided as is. We work to keep it accurate and available, but we do not promise that it will be error-free or uninterrupted, or that every recommendation will suit your trees. To the fullest extent the law allows, our total liability to you for anything arising from the app is limited to the amount you paid us in the twelve months before the claim. Some states do not allow some of these limits, so some may not apply to you.
Changes to these terms
If we change these terms we will update the effective date above, and we will tell you in the app if the change is significant. Continuing to use the app after a change means you accept it.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Apple is not a party to these terms and is not responsible for the app or its content, except as Apple's own terms say for purchases made through the App Store.
